Kwa wale ambao hawajapata taarifa bado, wenzetu waliorudishwa kazini, baada ya kupewa barua wameambiwa waripoti kwa mama Sawasawa. Walitiiila walichokikuta MUNGU mwenyewe ndiye ajuaye. Waliamuriwa walipe mafao yote waliopewa zaidi ya m 5 kila mmoja ndipo waliripoti.

DELIBARATION AND RELEASE OF THE STAFF DISCIPLINARY APPEALS COMMITTEE REPORT

RE: DELIBARATION AND RELEASE OF THE STAFF DISCIPLINARY APPEALS COMMITTEE REPORT



Reference is made to the above heading.



The University of Dodoma Academic Staff Association (UDOMASA) invites the University Council to recall that;



1. During the last quarter of the year 2011, and following the hearing and recommendations of the Staff Disciplinary Committee, the University Council terminated from employment a number of University Staff on various disciplinary actions.



2. Being aggrieved by the decision of the Council, the terminated staff knocked the doors of the Commission for Mediation and Arbitration (CMA) to pursue their rights, however, during the pendency of the employment matters at CMA, the University fulfilled the requirements of Rule 58 (1) of the University of Dodoma Charter, 2007 by composing the Staff Disciplinary Appeals Committee, to deal with and recommend to the Council on appeals made by members of the academic and administrative staff.



3. On the basis of the law, and considering the fact that, there was now an Appellate quasi-judicial body, to say, the Staff Disciplinary Appeals Committee, which receives appeals from the decision of the Council based on recommendations from the Staff Disciplinary Committee, the terminated staff with a view to exhaust the local avenues placed for pursuing rights at the University, withdrew their employment matters at CMA and lodged their appeals in the Staff Disciplinary Appeals Committee.



4. The said terminated staff were on the 10th day of February, 2012 properly summoned and appeared before the Staff Disciplinary Appeals Committee where upon being heard, expected for the results of the hearing to be read out and or to be announced, within five (5) days from the date of hearing, that is to say on or before the 15th day of February, 2012 as per employment laws and rules.



5. It is very unfortunate that the results in regard to the hearing of the appeals made on 10th February, 2012 are, until the day the University of Dodoma Academic Staff Association (UDOMASA) is writing this letter, not yet out.



6. In connection to the fate of appeals by the terminated staff, and considering the fact that, it was one of the agenda, the University Council in its meeting held on the 30th day of March, 2012, declined to delibarate on the report made by the Staff Disciplinary Appeals Committee on the ground that, the University Management was not notified of the hearing of the appeal, hence was not represented or in other words, the management did not appear before the Appelate body said above, thus was not heard.



7. Further to the above, the council made it worse by resolving that, the ‘purpoted’ non notification of the University Management, resulting to the so called “management not represented”  rendered the hearing and the Staff Disciplinary Appeals Committee report a nullity and that, it should re-hear the appeals and produce another report to be brought before the University Council for delibaration.



8. The University of Dodoma Academic Staff Association (UDOMASA) is very much concerned with the act of the Council at Paragraph 6 and 7 to the extent that;



8.1    The allegation by the Council that the Staff Disciplinary Appeal Committee did not notify the University Management is unfounded because; it is evident that the management was on the day of hearing, fully represented by well known University Staff from the management who included Mrs. Subira Sawasawa (DHRMA), Mr. John Kusaga (PAO) and Mr. Melkiori Sanga (LO).



8.2    The resolution by the Council for the Staff Disciplinary Appeal Committee to re-hear the appeals is unprocedural, unfounded and prejudicial to the fate of terminated staff in pursuing their appeal rights.



8.3    The act of the University Council to continue holding appeal reports in regard to a hearing made on 10th February 2012 is unlawful.





8.4    The management, in regard to the grievances against the Staff Disciplinary Appeals Committee, that they were not notified, represented or heard on appeal should not find its remedy at the hands of the University Council to bar delibaration and releasing by the Council, the Disciplinary Appeals Committee report; but should follow the proper avenues because by baring delibarartion and releasing of the same by the Council is purely dispensation of justice and misuse of the Council.





For the foregoing, UDOMASA calls for the university council to do the following:-



(a)    Dispense with its resolution dated 30th March, 2012 which declined delibaration and releasing the Staff Disciplinary Appeals Committee report;



(b)    Declare the hearing and recommendations of the Staff Disciplinary Appeals Committee made on the 10th February, 2012 as proper;



(c)    Release the Staff Disciplinary Appeals Committee report as continuing holding them is illegal;



(d)    Order the Management to mount its grievances in the proper avenues; and,



(e)    Without prejudice to what is called for at (a), (b),(c) and (d)above, if it is still the position of the Council that, the management was not represented in the Appeals Committee should charge and discipline those staff who purported to have represented the management in accordance with the law.





We the University of Dodoma Academic Staff Asociation (UDOMASA) reitarate to our humbled concern stated herein and proceed to resolve that, the Association which is obliged to take up and ensure the welfare of the University Academic Staff is maintained, is not ready to bear with such unproceduralities leading to prejudicing the terminated staff.



The Association further resolves that, it will take the appropriate steps if the Council will refuse and or neglect heeding to this letter.

MSIMAMO WA WANATAALUMA WA UDOM KUHUSU MAAMUZI YA BARAZA LA CHUO KIKUU CHA DODOMA KUKATAA KUPOKEA MAJIBU YA KAMATI YA RUFAA YA NIDHAMU YA WAFANYAKAZI



UTANGULIZI

Kumekuwepo na matukio ya kufukuzwa kazi wafanyakazi wa UDOM hasa wanataauluma kwa nyakati tofauti tofauti hasa mwishoni mwa 2011 na mwanzoni mwa 2012 kwa sababu mbalimbali zikiwepo za kinidhamu na nyingine. Matukio haya ya kufukuza kazi yamekuwa yakikiuka taratibu halali za kisheria (Sheria Na 6, 2004 ya Ajira na Mahusiano kazini) pamoja na sheria na kanuni nyingine za umma. Tafsiri pekee ambayo imekuwa ikihusishwa na matukio haya ya fukuzafukuza ni ulipizaji wa kisasi kwa wanataaluma kwa kuendesha mikutano endelevu mwanzoni mwa mwaka 2011 ili kutimiziwa madai mbalimbali yaliyokwamishwa kwa muda mrefu tangu Chuo kianzishwe.



Baada ya wafanyakazi waliofukuzwa kutoridhika na uhalali wa wao kufukuzwa, baadhi yao waliamua kuchukua hatua za kukata rufaa kwenye vyombo husika vilivyoundwa kwa mujibu wa sheria ili waweze kupata haki zao. Kwa upande wa chuo Kikuu cha Dodoma, chombo pekee chenye mamlaka ya kupokea na kusikiliza rufaa ni KAMATI YA RUFAA YA NIDHAMU KWA WAFANYAKAZI (Staff Disciplinary Appeal Committee) kwa mujibu wa sheria inayoongoza chuo yaani “University of Dodoma Charter” kanuni 58 (1). Uundwaji wa kamati hii ya rufaa ulikamilika mwishoni mwa mwezi wa kumi (10) 2011 baada ya muda mrefu toka chuo kianze kutoundwa, na mnamo tarehe 14/12/2011 katika kikao cha Baraza la Chuo, kamati ilipewa baraka ianze kazi rasmi tarehe 15/12/2011 yaani kesho yake.



Punde tu baada ya kamati kuanza kazi, rufaa za wafanyakazi watano (5) waliofukuzwa na tayari walishapeleka rufaa zao sehemu husika zilianza kutafutiwa utaratibu wa kusikilizwa. Kamati hatimae ilipanga na ilifanikiwa kusikiliza rufaa hizo mnamo tarehe 10/02/2012. Kwa maelezo ya mdomo toka kwenye kamati, majibu ya rufaa yatatolewa  baada ya kufikishwa kwenye baraza la Chuo ambalo lilifanyika tarehe 30/03/2012 siku ya Ijumaa. Kamati ilitimiza wajibu wake wa kupeleka taarifa ya majibu ili yapewe baraka ndipo yaweze kutolewa kwa wahusika.



Kwa mshangao mkubwa na kwa masikitiko ya ajabu, Baraza la Chuo lilikataa kata kata kupokea taarifa ya kamati kwa madai kwamba Menejimenti ya Chuo haikujulishwa kwa maandishi siku ambayo rufaa ilisikilizwa na hivyo mchakato wote haukuwa sahihi. Mbaya zaidi, Baraza liliamuru kamati irudie kusikiliza rufaa hizo upya.



Sisi wanataaluma wa UDOM tunapenda kueleza yafuatayo:

1.      Madai ya kuwa Menejimjenti ya Chuo haikujulishwa siku ya kusikiliza rufaa na hivyo haikuwakilishwa hayana msingi na ni propaganda za kupindisha ukweli kwani ushahidi unaonesha menejimenti ya chuo iliwakilishwa na maafisa wa chuo wanaotambulika. Waliowakilisha menejimenti wakati wa usikilizaji wa rufaa ni 1. Bi Subira Sawasawa (DHRMA) yaani Mkurugenzi wa rasilimali watu na utawala; 2. Bwana John Kusaja (PAO), yaani Afisa tawala mwandamizi na 3. Bwana Melkiori Sanga (LO) yaani Afisa Sheria wa chuo. Hawa watu walitumwa na nani na kwa maslahi ya nani?

2.      Kitendo cha agenda kutoka kwenye kamati ya rufaa kutopokelewa na Baraza la Chuo inaleta tafsiri ya kuwa pengine kuna ushawishi wa makusudi ulifanywa na menejimenti ya chuo ili kukwamisha agenda husika kwa sababu inazozijua yenyewe.

3.      Kitendo cha Menejimenti ya Chuo kupeleka malalamiko yake kwenye Baraza kwamba haikutendewa haki ni kuvuruga utaratibu wa kisheria uliopo kihalali kwani Baraza la Chuo lilishakamilisha kazi yake ya kufukuza na halipaswi kwa namna yoyote ile kuingilia kati utaratibu wa rufaa kinyume na utaratibu. Kama Menejimenti inaona haikutendewa haki, kuna vyombo halali vilivyopo kisheria ambapo inaweza kupeleka malalamiko yake na ikatendewa haki mfano CMA.

4.      Ifahamike pia kuwa kitendo cha baraza la chuo kuzima hoja kwa makusudi kutoka kwenye kamati ya rufaa ni matumizi mabaya ya baraza ambalo ni chombo muhimu sana katika taasisi hii ya elimu ya juu kwani si kazi yake kufanya hivyo.  

5.      Uamuzi wa Baraza la Chuo kuagiza kamati irudie kusikiliza rufaa upya ni kupindisha sheria kwa makusudi kwa maslahi yasiyojulikana na kuwafanya watu wengi kujiuliza maswali kulikoni majibu kutotolewa kwa muda wote huu, kuna nini?



Msimamo na Hitaji la UDOMASA

Tunapenda watu wote na umma kwa ujumla ujue msimamo na dai letu kuhusiana na jambo husika kama ifuatavyo

1.      Pamoja na kufahamu fika kwamba wafanyakazi wengi walifukuzwa bila kufuatwa taratibu za kisheria, sisi wanataaluma wa UDOM, tumeonesha ustaarabu wa kuridhisha kwa kuwashauri wenzetu waliofukuzwa kufuata njia na taratibu za kisheria ya kudai haki zao kwenye vyombo vilivyoundwa kisheria kwa kukata rufaa badala ya kuingia kwenye mikutano au migomo. Ustaarabu wetu huu unapaswa kutambuliwa

2.      Hatuko tayari kuona rufaa inasikilizwa upya kwani kufanya hivyo ni kutengeneza mazingira na desturi (precedence) ya sheria kupindishwa pasipo na sababu yeyote na pia ni tishio kubwa sana kwa misingi ya upatikananji haki sio tu kwa waliokata rufaa sasa bali hata kwa wafanyakazi wengine waliobaki kwa siku za usoni.

3.      Hitaji letu kwa sasa ni moja na ni rahisi sana; majibu ya kamati ya rufaa yatolewe, kama kuna upande wowote haujaridhika iwe upande wa Mlalamikiwa (Menejimenti ya chuo) au Walalamikaji (wakata rufaa) ni vema ufuate taratibu zilizopo kupata haki kwani sheria ziko wazi sana kwa manufa ya wote.

4.      Tuko tayari kutetea msimamo wetu huu kwa njia zote tunazoweza.

HUJUMA

Ndugu zangu wanaudomasa, niwape hongera na pole kwa kazi za kila siku. Naomba niwajulishe yaliyojiri katika kikao cha Baraza (Council) kuhusu RUFAA za kina DOTTO:-

1.        Katika kikao chake cha 23, Baraza la Chuo chini ya mwenyekiti wake Mh. Balozi Juma Mwapachu limetumia ubabe kukataa kupokea taarifa ya maamuzi ya kamati ya rufaa juu ya rufaa ya wafanyakazi waliosimamishwa kazi iliyosikilizwa tarehe 10/2/2012. 

2.        Hoja iliyopelekea maamuzi hayo ni kisingizio ya kwamba wakati wa kusikiliza rufaa menegimenti inadai haikutendewa haki kwa madai kwamba haikutaarifiwa kwa maandishi na hivyo basi haikuwakilishwa.

3.        Baraza baada ya tuhuma hizo kwenye kikao cha jana ikaamuru rufaa hizi zisikilizwe UPYA ndani ya mwezi wa nne na kamati tendaji ya baraza itakaa kwa dharura tarehe 30/4/2012 kwa ajili ya kupokea taarifa ya kamati ya rufaa.

Ndugu wanaudomasa, kwa kuzingatia yaliyojiri katika kikao hicho; ni wazi kuwa hii ni hujuma, dhuluma, unyanyasaji na mwendelezo wa ukiukwaji na upokonywaji wa haki zetu.

Ukweli halisi ni kwamba menejimenti ilikuwepo, hii inathibitishwa na yafuatayo:-

A.Uwepo wa Mwanasheria wa chuo (Bw. Melkiory Sanga), Mkurugenzi wa Rasilimali Watu na Utawala (Bi. Subira Sawasawa) na Afisa Mkuu wa Utawala (Bw. John Kusaja) katika vikao vyote vya rufaa, na kama wanakataa ya kuwa wao sio menejimenti, ni dhahiri kwamba wanatakiwa watuambie walienda kama nani? Na kutafuta nini katika vikao vya KAMATI HURU. Wakishindwa Kujieleza walienda kutafuta nini, inabidi hatua za kisheria zichukuliwe dhidi yao kwa kuvamia na kuvuruga shughuli za kamati huru ya rufaa.

B.                Barua za kuwaatarifu walalamikaji juu ya kusikilizwa kwa rufaa zao ilitoka katika ofisi ya mwanasheria wa chuo. Hivyo swala la kutokuwa na taarifa sio la kweli kwa sababu kwa taratibu za kiutawala, lazima mwanasheria wa chuo alipata ridhaa kutoka kwa kiongozi wake wa kazi.

MWONGOZO-
Kwakuzingatia yaliyotokea-
1.   kamati kuu ya UDOMASA imeshakaa na kushauriana na wanasheria na kutengeneza muongozo ambao unachanganua njia ambayo tutaelekea.
2.   Tunatarajia kuitisha kikao cha dharura baada ya pasaka - ili tupeane miongozo zaidi juu ya hatua gani za kuchukua. Taarifa kamili za kikao hicho zitatolewa mapema wiki ijayo- baada ya UDOMASA ex-com kukaa jumatatu ya tarehe 2/4/2012.

Ph.D TRAINING OPPORTUNITIES UNDER DANIDA/UDSM-BSUEC-CLIMATE AND ENVIRONMENT PLATFORM-2012


Background
The Environment & Climate Platform (BSUPEC) is one of four platforms in the initiative “Building Stronger Universities in Developing Countries” (BSU). BSU is a partnership between research and higher education institutions in developing countries and Danish universities. The overall objective of the BSU initiative is to strengthen universities in developing countries to increasingly play a role in the economic, social and political development of the societies in which they are located. 

The BSUPEC initially involves partner institutions from Ghana, Tanzania and Denmark. The development objective of the platform is to contribute to informed and improved, sustainable natural resource management and environmental protection considering the needs for sustainable livelihoods, including adaptation and mitigation to climate change – through research capacity building in Ghana and Tanzania. 

Based on relevance for environment and climate in Tanzania and reflecting the capacities, approaches and expertise within the research area, the BSUPEC has initially identified five academic focus areas: (i) Sustainable land use and management; (ii) Sustainable water use and management; (iii) Energy and waste in rural and urban linkages; (iv) Climate change; and (v) Sustainable innovations and planning.
The initiative receives core funding from Danida and is co-funded by the participating universities. Read more about the platform on www.bsuec.org.
